Many philosophers endorse “exclusionism”, the view that no instance of relearning qualifies as a case of genuine remembering, and vice versa. Appealing to simulationist, distributed causalist, and trace minimalist theories of remembering, I develop three conditional arguments against exclusionism. First, if simulationism is right to hold that some cases of remembering involve reliance on post-event testimonial information, then remembering does not exclude relearning. Second, if distributed causalism is right to hold that memory traces are promiscuous, then remembering does not exclude (...) relearning. Finally, if trace minimalism is right to hold that vicarious experiences sometimes produce the minimal traces that ground remembering, then remembering does not exclude relearning. While advocates of these theories might incorporate additional conditions designed to accommodate exclusionism, the only reason they can appeal to in favor of doing so is intuition: neither the fundamental components of the theories nor the empirical results on which they are based provide a reason to endorse exclusionism. An investigation of exclusionism thus raises metaphilosophical questions, so far overlooked in philosophy of memory, about the appropriate role of intuition in theorizing about remembering. (shrink)

The paper has been written from a philosophical perspective and triggered by the recurrent discussions in psychology about the most suitable methods to study our multifaceted subjectivity. Its main point is that a phenomenological understanding of the human person provides a robust and also flexible philosophical framework for psychology. The first part discusses three classical distinctions –individual/general; explaining/understanding; induction/interpretation– which, in spite of possible deficiencies, are useful to illustrate the specificity of the human sciences relative to the natural sciences. If (...) not understood as an either-or dichotomy these distinctions represent the search of the right balance to reflect the complexity and richness of psychological science. The second part presents the phenomenological notions of ‘vital reduction’ and ‘personalist reduction’, where reductions does not take on an eliminativistic meaning, but of directing the mind’s gaze to attend to what is originally the case. The ‘vital reduction’ reveals a subject of experience at the center of the lifeworld, and the ‘personalist reduction’ sees in rationality –i.e., the power to grasp the meaning of things and to recognize other subjects of experience­– a deeper dimension of the subject, who we can thus call a person. Psychology and phenomenology converge in disclosing the person-centeredness of our lifeworld. (shrink)

Borobia, F. F. Labastida, P. Blanco, L. Romera, J. J. Franck, J.M. Galván and J. Alonso).

In this article, we study Latin American populist constitutions and their uses, seeking to analytically understand whether populist constitutionalism is, indeed, a thing. We posit that Latin American populist constitutionalism is a particular form of mixed constitutionalism in three senses: first, as a specific combination of substantive traits that includes both empowering and (some) constraining devices; second, as a peculiar politics of constitutional change that incorporates popular mobilization against pre-existing institutions as a key trait; and third, as a particular practice (...) of constitutional enforcement that involves weak and selective implementation, often through institutional capture. By considering not only the texts of constitutions but also the ways in which they are changed and implemented, we hope to complement legal perspectives of mixed constitutions with a sociopolitical analysis of practices and contexts. By capturing the distinctive contribution of Latin American populism to the discussion of mixed constitutions, we seek to challenge both legal conceptions of constitutionalism that reduce it to negative or constraining features, and political conceptions of populism that simply equate it to authoritarian rule. Busca cuestionar la rigidez de la objetividad y reconocer los límites de la razón humana. Finalmente, se espera describir una propuesta de epistemología más flexible para su vinculación con la investigación educativa, con la intención de dotarla de especificidad.

Fernández’ most recent book constitutes an articulated development of several philosophical considerations on memory displayed in previous, and forthcoming publications. The result of such articulated development ends up being a consistent account that provides an innovative and thought-provoking perspective on episodic remembering. This volume not only gathers and articulates the author’s previous ideas, but also provides new reflections, and objections that encompasses four significant domains in the philosophy of memory. In this paper, we propose to investigate one common adult representation of childhood that will serve both to reflect on and to problematize current and varied representations. As such, our object of study will always be a representation and not a substantialist definition. We propose to analyze the adult concept “child” from a critical perspective by reviewing it through a historical lens—that is, as it is expressed in the political and educational world of 19th century Chile, which, in turn, we (...) can glimpse in the historical writings of Domingo Faustino Sarmiento. To carry out this journey, we propose three guiding thematic axes: 1) how all school apparatuses embody, configure and assume a certain identifiable representation of “child’ and childhood; 2) an analysis of the characteristics and objectives of the 19th century Chilean school apparatus, particularly in its function as a government device, or dispositif; 3) just how that dispositif becomes visible to inquiry in the historical record, particularly in what it can reveal to us about the image or images of childhood held by adults. To be understood by adults as a boy or a girl in Chile during that period is communicated in the historical record through a myriad of diverse sources, each requiring consideration in its context. Magazines, syllabaries, school textbooks and children's stories configure different perspectives on and attitudes toward childhood, which in turn are associated with the social origin of these documents and the purposes they embody. The images, ideas and signs of interaction that appear in these school documents act cumulatively to reveal a cultural image of “child” and aid us in understanding the political and socio-cultural significance attributed to that period in the human life-cycle. And while we cannot claim to have identified how all adults of 19th century Chile understood and represented childhood, such documents do offer insights into the beliefs and assumptions of the political and ruling classes. In this work we review the three principal theses that Ignatio Vincentio, a Spanish thinker of the seventeenth century, defends about the agent intellect: 1) it is the same potency as the possible intellect, only with a formal distinction and plurality of names; 2) it has three tasks: a) to illuminate phantasmata, b) to make them intelligible in act, and c) to abstract the intelligible species from them; and 3) it will remain in the separated soul performing the same task (...) as in the present situation [?], but without conversion to phantasmata. Rosmini’s philosophy is a comprehensive effort toward the renovation of Christian thought in modern times. An intense discussion of the problem of knowledge led him to reformulate Augustine’s theory of illumination in terms of the ideal presence of universal being to the mind. Universal being is the lumen intellectus and our mind’s first object: it is implied in all our thoughts and makes them possible. Although devoid of reality, it shows remarkable features, such as infinity, necessity, and eternity. Without being (...) God, it may be called “divine,” and confers a special value to intelligent creatures, whose dignity comes from their being enlightened by universal being. The “divine” is also the seal of God’s presence in nature. The present article supports the logic of this argument. (shrink)

The counterfactual thinking cannot be only developed in early childhood, but it also could be a requirement for the causal reasoning. In this research a replica of German was made using counterfactual stories with Latin American kids between three and four years, demonstrating the possible main role counterfactual reasoning, by using computer animations. This was a different approach to the most recent made by Nyhout and Ganea. Nonetheless, the participants of the study evidenced counterfactual reasoning to the relevant choice and (...) the negative consequence conditions shown on the stories that represented the choices made by a starting role. Although some of the results were not totally conclusive under the analyzed conditions. Lastly, some possible not controlled effects are discussed from stories shown to the children, that could have motivated the counterfactual thinking. (shrink)

BackgroundDistorted gambling-related cognitions are tightly related to gambling problems, and are one of the main targets of treatment for disordered gambling, but their etiology remains uncertain. Although folk wisdom and some theoretical approaches have linked them to lower domain-general reasoning abilities, evidence regarding that relationship remains unconvincing.MethodIn the present cross-sectional study, the relationship between probabilistic/abstract reasoning, as measured by the Berlin Numeracy Test, and the Matrices Test, respectively, and the five dimensions of the Gambling-Related Cognitions Scale, was tested in a (...) sample of 77 patients with gambling disorder and 58 individuals without gambling problems.Results and interpretationNeither BNT nor matrices scores were significantly related to gambling-related cognitions, according to frequentist analyses, performed both considering and disregarding group in the models. Correlation Bayesian analyses largely supported the null hypothesis, i.e., the absence of relationships between the measures of interest. This pattern or results reinforces the idea that distorted cognitions do not originate in a general lack of understanding of probability or low fluid intelligence, but probably result from motivated reasoning. La Masonería es una organización que ha estado presente en España, como en el mundo, en los períodos liberales y que ha sido perseguida y ha desaparecido casi en los totalitarismos, sean comunistas o fascistas. La masonería española, tradicionalmente vinculada el modelo europeo continental, ha concedido gran importancia a la participación activa en los grandes debates sociales. El cometido fundamental de la masonería es la formación de sus miembros como individuos y como ciudadanos. Desde tal perspectiva, los talleres masónicos han (...) sido reconocidos como auténticas escuelas de formación de elites democráticas y constituyen un capítulo tan importante como ignorado de nuestra cultura política. Además, la masonería ha mostrado un sobresaliente interés hacia la enseñanza, llegando con frecuencia a reducir las grandes cuestiones sociales a un problema educacional. Dentro del marco ético-jurídico laicista, la reflexión sobre la acción formativo-democrática de la masonería se centra con intensidad creciente en ¿educar para la paz¿. Un ejemplo relevante del legado cultural pacifista de la masonería histórica lo constituye los siete insignes masones distinguidos con el Premio Nobel de la Paz. La masonería debe considerase pues, por derecho propio, como una escuela de formación laica para la democracia y para la paz. (shrink)

The debate over judicial review of legislation is profuse. But differences are often due to the lack of a common methodology. This article discusses the proper way to evaluate judicial review and confronts central challenges raised against it. It develops the two main models that can be used for analyzing the intersection between democracy and constitutional decision-making and shows that judicial oversight may not be rejected, regardless of how we interpret that connection. The article discusses in detail the model developed (...) by Jeremy Waldron. A nice attempt to answer methodological questions, Waldron's model wrongly tips the balance against judicial review. Its excessive level of abstraction and idealization renders it inoperable. Few systems meet its standards, and those that do pay a high price: they contradict the concept of democratic legitimacy that underlies the model. Paradoxically, a system with judicial review may end up being more legitimate than one without it. (shrink)

The research is developed with the use of deductive and descriptive analytical methods used to obtain information on doctrine and jurisprudence and to establish and describe specific situations in the field of Ecuadorian Medical Law respectively. The main objective is to provide scientific and doctrinal tools to understand guilt in cases of omissive conduct in Ecuadorian medical practice, as well as its comparison with other countries such as Colombia, Mexico, Cuba and Argentina, the results of the research show that the (...) doctrine in the relationship to the categories of Omission, Guilt, Guarantor Position and Permitted Risk is broad and is based on scientific-doctrinal advances of the Normative Conception of Guilt comprised between 1995 and 2022. To establish useful criteria and conclusions, the discussion focuses on defining what is considered “guilty” in the context of Medical Law, highlighting the importance of elements such as the objective duty, the harmful result and the analysis of the concomitant circumstances, emphasizing the importance of considering the context and development of the facts in cases of omissive conduct in medicine and not only the result. In relation to omissions in criminal law, a distinction is made between proper and improper and finally, it concludes by suggesting the modification of article 146 of the Organic Integral Criminal Code to guarantee due process and a effective judicial protection in matters related to health in Ecuador, specifically with regard to causality in cases of omissive conduct. COVID-19 has resulted in extraordinary disruptions to the higher education landscape. Here, we provide a brief report on 295 students’ academic perceptions and emotional well-being in late May 2020. Students reported the high levels of uncertainty regarding their academic futures as well as significant levels of stress and difficulty coping with COVID-19 disruptions. These outcomes were related to the higher levels of neuroticism and an external locus of control. Female students reported worse emotional well-being compared to males, and the students (...) of color reported the significantly higher levels of stress and uncertainty regarding their academic futures compared to White students. These results suggest that some students may be at particular risk for academic stress and poor emotional well-being due to the pandemic and highlight the urgent need for intervention and prevention strategies. According to proponents of irreducible cognitive phenomenology some cognitive states put one in phenomenal states for which no wholly sensory states suffice. One of the main approaches to defending the view that there is irreducible cognitive phenomenology is to give a phenomenal contrast argument. In this paper I distinguish three kinds of phenomenal contrast argument: what I call pure--represented by Strawson’s Jack/Jacques argument --hypothetical-- represented by Kriegel’s Zoe argument --and glossed-- first developed here. I argue that pure and hypothetical phenomenal (...) contrast arguments face significant difficulties, but that there is a sound glossed phenomenal contrast argument for irreducible cognitive phenomenology. According to kin selection theory, indirect reproductive advantages may induce individuals to care for others with whom they share genes by common descent, and the amount of care, including self-sacrifice, will increase with the proportion of genes shared. Twins represent a natural situation in which this hypothesis can be tested. Twin pairs experience the same early environment because they were born and raised at the same time and in the same family but their genetic relatedness differs depending on zygosity. We (...) compared the degree of willingness to fight and sacrifice for the co-twin among monozygotic and dizygotic pairs in a sample of 1443 same-sex and opposite-sex twins. We also analyzed the effect of the subject’s gender and that of the co-twin on those altruistic behaviors. Results partly supported the postulated explanation. MZ twins were significantly more likely than DZ twins to self-sacrifice for their co-twins, but zygosity did not affect willingness to fight for him/her. The genders of the subject and of the co-twin, not genetic relatedness, were the best predictors of aggressive altruistic intentions. (shrink)

En la actualidad existe una divergencia entre el consentimiento informado vigente con las necesidades particulares de las Unidades de Terapia Intensiva, mismas que se caracterizan de las demás áreas de salud intrahospitalarias puesto que los pacientes se encuentran bajo sedoanalegesia. Esta situación impide a los pacientes la toma de decisiones y expresión de su voluntad en relación con los procedimientos que incluyen durante su tratamiento médico debido a una situación emergente o planificada. Otros países han respondido a esta necesidad al (...) implementar un documento legal que aborde todas estas inquietudes tanto para el paciente, familia como para el personal médico. Además, parte de esta problemática incluye el no cumplimiento de la Ley de Protección de Datos Personales debido a que el material audiovisual obtenido de los pacientes en el área crítica no es respaldado por el permiso escrito de los involucrados. En esta investigación documental se abordará esta carencia. (shrink)
